On December 23, 2011, The National Labor Relations Board issued a press release announcing its decision to postpone the implementation date for the new notice-posting rule, again, at the request of the federal court in Washington, DC. The implementation date is now April 30, 2012!
As you may already know, most private sector employers will be required to post the “Employee Rights” notice advising employees of their rights under the National Labor Relations Act. The notice should be posted in a conspicuous place, where other notifications of workplace rights and employer rules and policies are posted. In addition, if employers post personnel policies or workplace notices on an internal or external website, they are also required to add a link to the “Employee Rights” notice in the same location.
For further information about the posting, including a detailed discussion of which employers are covered by the NLRA, and what to do if a substantial share of the workplace speaks a language other than English, please see the Frequently Asked Questions, or contact the agency at questions@nlrb.gov or 866-667-NLRB.
